Welcome to Balham House Clearance. By engaging our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before proceeding.

1. Definitions

In these Terms and Conditions:

  • "Client" refers to the individual or entity engaging our services.
  • "Services" refers to all house clearance services provided by the Company.

2. Services Provided

Balham House Clearance offers comprehensive house clearance services, including but not limited to:

  • Residential and commercial clearances
  • Furniture removal
  • Waste disposal and recycling
  • Special item handling

All services are performed with the utmost care and professionalism to ensure client satisfaction.

3. Booking and Payment Terms

3.1 Booking Process

Clients can book our services through our online platform or by contacting our customer support. Upon booking, a confirmation will be sent to the client detailing the service schedule.

3.2 Payment

All payments for services must be made in full prior to the commencement of the clearance. We accept various payment methods including credit/debit cards and bank transfers.

  • Full payment is required at least 24 hours before the scheduled service.
  • For large-scale clearances, a deposit may be required.

Failure to comply with payment terms may result in the cancellation of the booking without refund.

4. Cancellation Policy

Clients may cancel their booking under the following conditions:

  • Cancellation made at least 48 hours before the scheduled service will receive a full refund.
  • Cancellation made less than 48 hours before the scheduled service will incur a fee equivalent to 50% of the total service cost.
  • In the event of a no-show, the full service cost will be charged.

To cancel a booking, clients must contact our support team via the provided communication channels.

5. Liability and Insurance

Balham House Clearance is committed to handling all items with care. However, the following terms apply:

  • The Company holds liability insurance to cover accidental damage or loss during the clearance process.
  • Clients are responsible for informing the Company of any valuable or fragile items requiring special attention.
  • In cases of pre-existing damage to items, the Company is not liable for further damage unless caused by negligence.

For high-value items, additional insurance coverage can be arranged upon request.

6. Customer Responsibilities

Clients agree to the following responsibilities:

  • Ensure all clearable items are accessible on the scheduled clearance date.
  • Secure permission from property owners if the clearance involves third-party properties.
  • Remove any hazardous materials that the Company is not equipped to handle.

Failure to comply may result in additional charges or the discontinuation of services.

7. Privacy Policy

Your privacy is important to us. We collect and use personal information in accordance with our Privacy Policy, which outlines how data is gathered, stored, and protected. By using our services, you consent to the terms outlined in our Privacy Policy.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Balham House Clearance operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the local courts.

9. Amendments to Terms

Balham House Clearance reserves the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.

10. Dispute Resolution

In the event of a dispute, both parties agree to seek an amicable resolution through negotiation. If a resolution cannot be reached, disputes will be handled in accordance with the governing law provisions outlined above.

11. Force Majeure

The Company shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power, or confiscation.

12. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under any applicable law, such invalidity will not render these terms unenforceable or invalid as a whole. Such provisions will be deleted without affecting the remaining provisions herein.

13. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and Balham House Clearance regarding the subject matter herein and supersede all prior agreements, representations, and understandings, whether oral or written.

14. Intellectual Property

All content provided by Balham House Clearance, including but not limited to text, graphics, logos, and images, is the property of the Company and is protected by applicable intellectual property laws. Unauthorized use of any materials is prohibited.

15. Feedback and Complaints

Clients are encouraged to provide feedback or raise complaints regarding our services. All feedback is valued and considered for improving service quality. Complaints will be addressed promptly in accordance with our internal complaint resolution procedures.

16. Third-Party Services

Occasionally, we may engage third-party service providers to assist in the clearance process. While we strive to work with reputable partners, Balham House Clearance is not responsible for the actions or omissions of third-party providers.

17. Confidentiality

Both parties agree to maintain the confidentiality of any confidential information disclosed during the course of service. This obligation remains in effect even after the termination of the service agreement.

18. Termination

Either party may terminate the service agreement under the following conditions:

  • Material breach of the Terms and Conditions by either party.
  • Mutual agreement to terminate the service.

Termination notices must be provided in writing, and any outstanding obligations must be fulfilled before termination is finalized.

19. Assignment

Clients may not assign or transfer their rights or obligations under these Terms and Conditions without the prior written consent of Balham House Clearance. The Company may assign its rights and obligations to a third party without restriction.

20. Notices

All notices required or permitted under these Terms and Conditions shall be in writing and deemed effectively given upon receipt. Notices may be delivered personally, by email, or by certified mail to the addresses specified by each party.

21. Waiver

The failure of Balham House Clearance to enforce any provision of these Terms and Conditions shall not be deemed a waiver of future enforcement of that or any other provision.

22. Headings

The headings in these Terms and Conditions are for convenience only and have no legal or contractual effect.

23. Independent Contractors

Both parties acknowledge that they are acting as independent contractors and not as agents, partners, or employees of the other party. Nothing in these Terms and Conditions shall be construed to create a joint venture or partnership between the parties.

24. Compliance with Laws

Both parties agree to comply with all applicable laws, regulations, and ordinances in the performance of their obligations under these Terms and Conditions.

25. Indemnification

Clients agree to indemnify, defend, and hold harmless Balham House Clearance and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses arising out of or connected to the use of our services or violation of these Terms and Conditions.

26. Time is of the Essence

Time is a critical element of the service agreement. All dates and times specified are essential, and compliance is required to ensure the smooth provision of services.
